For defendants, a diligently calculated and appropriately executed Criminal Defense Investigation affords a potentially favorable outcome. Optimally, the investigation reveals proof the defendant is innocent of the state’s charges. To a lesser extent yet critically important is the discovery of relevant and decisive evidence that potentially creates reasonable doubt in the minds of judges or jurors as to the guilt of the defendant. Or, evidence may establish the defendant’s guilt at a lesser degree than charged or result in a lesser sentence. Criminal Defense Investigation could also determine if the defendant’s constitutional rights were violated.

Investigations must be initiated as soon as possible after the defendant is charged in criminal court or in some cases, when charges are anticipated. This is due to a number of key factors: a witness’s ability to accurately recall the facts diminishes; physical evidence may be lost or destroyed; and the physical situation of the crime scene changes almost immediately after an event occurs. This is true of the sites of geographically separated yet critical events as well.


The factual basis and the strength of the prosecution’s case will generally dictate the theory of defense. Due process of law, the defendant’s innocence, and/or the violation of constitutional rights are generally the focus of the defense.
